PARTAY.FUN
Terms of Service
Effective and last updated: · Version 2026-10-27
Please read before joining. PARTAY is for adults aged 18 or older. Be respectful, use your own account and content, and do not scam, harass or exploit anyone. Paid features are optional. VIP renews until cancelled, virtual items work inside the service, and gifts can expire. Australian consumer guarantees and other rights that cannot lawfully be excluded remain protected.
These Terms of Service are the rules for using PARTAY. Our Privacy Policy explains how information is handled.
1. Your agreement with PARTAY
These Terms of Service (“Terms”) govern the PARTAY.FUN website, current browser application and the features offered through them, including character creation, games, matchmaking, guest invitations, profiles, messaging, voice, virtual currency, digital items, subscriptions and sharing. The service is provided by Name a friend, trading as PARTAY.FUN (“PARTAY”, “we”, “us” or “our”). Contact details appear in section 22.
By creating an account after being shown the agreement notice, or using a guest-play feature after being shown its notice, you agree to these Terms. If you do not agree, do not create an account or start a guest game. The Privacy Policy describes our handling of personal information; acknowledging it does not waive your privacy rights or replace a separate consent required by law.
A specific purchase may have additional terms displayed before you confirm it, such as its price, contents, billing period, expiry or promotion conditions. Those terms apply to that purchase alongside these Terms. Mandatory law takes priority over any inconsistent provision. We will not treat a notice shown only after a purchase as changing the price or material conditions you already accepted.
2. Adults-only eligibility
You must be at least 18 years old and legally able to enter this agreement where you use the service. This applies to both queues, all chats, character creation and guest invitations. Provide a truthful date of birth and do not assist a minor to access PARTAY. If local law sets a higher applicable minimum age or prohibits a feature, you must comply with that law.
Age declarations and profile fields do not prove that another user’s age, identity, relationship status or intentions have been independently verified. We do not currently conduct government-ID checks or background screening. We may reasonably request clarification of eligibility or restrict access while an eligibility or safety concern is assessed.
3. Accounts, sign-in and account security
Account authentication is provided through WorkOS/AuthKit and any supported login method you choose. Keep your credentials and devices secure, provide accurate information and promptly tell us if you suspect unauthorised access. Do not impersonate another person, lend or sell an account, use someone else’s credentials or create accounts to evade restrictions or repeatedly collect introductory rewards.
Your character, profile, progress, messages, purchases and entitlements may be linked to the verified account. Some drafts and preferences are stored on the browser. Clearing site data can remove local drafts without deleting server records. Signing out does not cancel VIP or close your account.
Beta codes, invitation links and public character-share links have different purposes. A shared beta code does not make an account private. Treat a friend invitation as a link that another person may forward; it is not a guarantee of the recipient’s identity.
4. Games, matching and service availability
PARTAY combines cooperative games with social features for friends or something more. Queue entry is subject to the current event schedule, saved preferences, available players and technical requirements. You may need to provide location permission, photos or a gender preference for particular features. Distance estimates use approximate location and may be inaccurate near a preference boundary. An invitation to a known friend is a separate way to play and need not follow public-queue availability or matching preferences.
We do not promise that a compatible person will be online, that a match or conversation will occur, or that a connection will become a friendship or relationship. A wave, heart, accepted invitation or gift does not create an obligation to communicate, meet offline, reciprocate, consent to intimacy or continue a relationship. An active VIP may be shown a teammate’s match selection before a mutual selection occurs, as described by the feature.
Games continue according to their rules, including turns, lives, retries and automatic requeue/countdown behaviour. Opening a purchase or information popup does not necessarily pause an online game. Internet access, compatible hardware, browser permissions and any data charges are your responsibility. Temporary maintenance, connection failures, interruptions and bugs can affect play, scores, calls or purchases.
The service is currently a beta. We may reasonably maintain or change free features to improve safety, reliability and the experience. Beta status does not excuse a failure to provide purchased benefits or remove rights and remedies protected by law.
5. Voice and communication requirements
Microphone access is required before entering a game queue or an invited game. Voice can connect automatically with the other player once the required permission and connection steps are complete. The app can show speaking indicators and perform an activity check. After a reminder, a player who does not use the microphone may be removed from that game. A technical interruption may also require reconnecting or rejoining.
In chats, use the microphone control and the app’s connection indicators. Accepted chat invitations may initiate voice. Stop or mute transmission where supported, leave the chat/call, or revoke browser permission if you do not wish to transmit. Do not rely solely on an icon if your device or browser indicates that a microphone remains in use.
Do not record, publish or redistribute another person’s voice, messages or private photos without their permission or another lawful basis. The current PARTAY application does not record or transcribe calls, and we cannot stop someone making an external recording. Text chats are stored for the chat feature. Full details are in the Privacy Policy.
6. Community and acceptable-use rules
Use the service lawfully and respectfully. You must not:
- Threaten, stalk, bully, harass, intimidate, hate on or discriminate against another person, including through voice, chat, profile content or repeated invitations.
- Coerce sexual or romantic attention, send unwanted sexual content, share another person’s intimate content, engage in sextortion, or use gifts or spending to pressure someone.
- Upload sexual-exploitation material, content depicting or sexualising children, illegal pornography, non-consensual intimate imagery, graphic abuse or other illegal content. Do not use photos of minors as profile selfies.
- Upload nude or sexually explicit real-person profile photos. Stylised adult avatar clothing and animations do not authorise prohibited real-person material or abusive conduct.
- Impersonate someone, misrepresent your age, use stolen photos, expose another person’s private information, or deceptively solicit money, payment details, credentials or off-platform transfers.
- Spam, promote scams, distribute malware, make unlawful commercial solicitations, or encourage illegal or dangerous conduct.
- Cheat, bot, manipulate matchmaking or scores, exploit bugs, forge game/reward/payment requests, bypass an entitlement, farm promotions through duplicate accounts, or trade accounts and virtual currency outside authorised features.
- Probe or disrupt systems, scrape other users’ information, attempt unauthorised access, reverse engineer in a way prohibited by applicable law, or interfere with another person’s ability to use the service.
- Infringe intellectual-property rights or submit content that you do not have permission to provide and share for the intended purpose.
You may describe a security issue responsibly to our contact without exploiting it against other users or accessing more information than necessary to identify the issue. These rules do not restrict lawful criticism, good-faith complaints or the exercise of consumer rights.
7. Personal safety, reports and moderation
Use your own judgement when communicating or meeting someone. Keep financial credentials and precise home/work addresses private, and do not send money to someone because they claim to be another user or PARTAY staff. We do not endorse other users or guarantee their conduct. If you feel unsafe, leave the interaction and use the contact in section 22 to report what happened.
For a report, provide the account/character name, approximate date and time, the relevant chat or game information and a description of the concern. Do not send illegal exploitation material as evidence; describe where it can be located. We may reasonably request further details, restrict relevant features, remove content or preserve information while reviewing a report. We cannot promise continuous live monitoring, immediate review or detection of every harmful interaction.
You may also use the eSafety Commissioner’s reporting pathways for eligible serious online abuse, image-based abuse or illegal content. Contact local emergency services or police for immediate danger or suspected criminal activity. Contacting PARTAY is not an emergency-response service.
8. Your content and sharing permissions
You retain the rights you hold in your own original photos, text and other submitted content. You give us a non-exclusive licence, for as long as needed to operate the feature and meet lawful retention needs, to host, store, reproduce, resize, format, transmit and display that content to the audiences you select or that the feature describes. This includes the necessary use by providers supporting the service. The licence does not give us a general right to sell your private content or use your real-person photos in an advertising campaign without separate permission.
You confirm that you have the rights and permissions required to submit the content and that doing so does not violate another person’s rights. Do not submit sensitive details about someone else without an appropriate basis. Profile prompts can be shown to your teammate during a game before a mutual match. Selfies and the full shared profile are available through authorised connection features, which can include accepted chat invitations.
If you generate a public character-share link or share a score/tower image, you authorise the publication needed for that feature. Anyone with a public link can view and forward it. Removing or changing a profile does not automatically retract a snapshot already shared elsewhere. You can ask us to disable a public character-share link. Copies independently made by recipients may remain outside our control.
9. PARTAY’s software and digital assets
PARTAY’s software, brand, interface, game systems and supplied character/item assets belong to us or our licensors, subject to applicable third-party and open-source licences. We grant you a limited, personal, non-exclusive permission to use them through the service in accordance with these Terms. You may share character and tower previews using the supplied sharing tools and ordinary personal screenshots, subject to others’ rights and these Terms.
A digital-item unlock allows use of that item in the service; it does not transfer ownership of the underlying software or artwork, grant commercial merchandising rights or permit resale outside authorised features. Nothing here limits rights that applicable open-source licences or mandatory law give you.
10. Payments, checkout and fulfilment
Before paying, check the price, currency, quantity, included items and any recurring billing or expiry information shown for the offer. Prices displayed as AU$ or AUD are Australian dollars. Any additional tax, currency conversion or payment-provider charge should be assessed from the checkout and your payment provider’s terms before confirmation.
Checkout is handled by Stripe or the payment service identified at purchase. You must be authorised to use the payment method. We fulfil paid offers after receiving the required payment confirmation. A browser redirect, pending payment or screenshot of checkout is not by itself proof of a completed purchase. Confirmation may be delayed by the payment service or a technical fault.
Keep your receipt/reference and use the wallet refresh option or contact support if a completed purchase is missing. Do not pay twice to solve a delayed grant. Our records link payments and grants to the account used for checkout; contact us promptly if the wrong account was involved. Payment-provider terms apply to their processing, but do not replace our obligations to supply what you bought.
11. P-Bucks, rewards and item unlocks
P-Bucks are a service-specific virtual currency used for features and digital items described in the app. They are not money, a deposit, an investment, a security or a promise of financial return. They cannot be redeemed for cash, withdrawn, sold or transferred outside an authorised in-app feature. Their purchase price does not create a fixed exchange value for individual items or promotions.
P-Bucks may be purchased or awarded through eligible gameplay and promotions. Current level-up rewards are 10 P-Bucks for a newly earned level, or 20 for a level earned with active VIP. The server verifies progress and prevents duplicate grants. A bonus attaches to the qualifying event and account; repeatedly loading a page, replaying a response or switching devices does not earn it again.
The current welcome wheel is a presentation of a guaranteed 200 P-Buck welcome award, not a random-money prize. Other introductory, calendar-day or invitation rewards have the eligibility and limits shown by their feature. Promotional reward rules can change prospectively; a change does not justify reversing a legitimate completed paid purchase or an already-earned reward without a valid reason.
Purchased P-Bucks do not currently have a scheduled expiry. A promotion may have a clearly disclosed claim period or expiry condition. A permanent item unlock means no scheduled item expiry while the account and service remain available, rather than ownership outside the service or a promise that the service will exist forever. Temporary items have the expiry shown for them.
Trying on an item does not by itself purchase it. Review the outfit’s quoted cost and selected paid items before confirming. The app may restore an earlier item if you remove an unowned selection or do not complete the purchase. Legitimate purchases and wallet balances must be handled in accordance with the offer and your consumer rights.
12. VIP subscriptions
VIP is an optional recurring subscription. The checkout shows its price and billing interval. It renews and your chosen payment method is charged each billing period until you cancel renewal. Do not subscribe if you only want a one-time purchase.
The current VIP benefits shown in the app include access to the third outfit slot, four eligible handheld gifts per billing month, 500 P-Bucks per billing month, visibility of the teammate’s match selection and double P-Bucks from newly earned levels. The doubling applies to level-up rewards; it does not double bought currency, the monthly allowance, introductory bonuses or other promotions unless an offer expressly says so.
Monthly currency and gift allowances depend on verified subscription entitlement and paid billing periods. Unused monthly free-gift allowances do not roll over and do not include pet gifts. Credited P-Bucks are not removed merely because you did not spend them during that month. Multiple overlapping subscriptions do not stack the same account’s monthly allowance.
You can cancel renewal through Profile → Manage subscription, which opens the subscription management portal, or contact us if you cannot access it. Cancellation normally stops the next renewal and benefits continue until the paid-through period ends, unless a refund or other applicable rule ends them earlier. Signing out, clearing browser data or ceasing to play does not cancel renewal.
When VIP ends, VIP-only access ends: the third outfit slot becomes unavailable for active use while the saved outfit is retained, free-gift allowances stop and future level-up rewards return to the ordinary rate. Existing permanent item ownership is not removed solely because VIP ends. Changes to price or material recurring benefits will be explained before they apply to a renewal, with a reasonable opportunity to cancel and any further notice or remedy required by law.
13. Gifts, bundles and limited drops
Gifts are digital in-service items. The selection screen identifies the item, P-Buck cost and whether an available VIP gift allowance applies. A delivered gift can immediately change an equipped handheld item or pet. Current gifted items last one week unless an offer clearly states otherwise. A temporary gift does not become a permanent unlock merely because it is equipped when the gift expires. Its expiry may restore an earlier eligible selection.
A gift is voluntary. The recipient owes no attention, match, response, relationship or repayment. Gift delivery, expiration and refund questions are subject to the same consumer protections as other eligible purchases. Do not use gifting for harassment or to avoid a communication restriction.
Starter packs and other bundles contain only the items and currency identified for that offer. Any advertised saving/value comparison is a comparison to the stated in-app reference prices, not a cash resale value or guaranteed future discount.
A paid loot box has a random digital-item outcome. Review its cost, available item pool, rarity/odds and event deadline before confirming. The current limited-drop system excludes already-owned items from the remaining pool, so displayed odds can change as you unlock items. A rare result is not guaranteed by buying a particular number of boxes unless every remaining item has been exhausted under the disclosed no-duplicate rules.
Event deadlines limit the ability to open boxes; they do not, by themselves, expire an item described as a permanent unlock. Loot-box items and P-Bucks have no cash redemption or authorised external resale. Do not spend money you cannot afford or treat random digital drops as a way to make money. Availability can be restricted where required by law.
14. Refunds and mandatory consumer rights
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, remedy or other right that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. Where those rights apply, they take priority over purchase conditions, “beta” labels, expiry rules and any liability wording in these Terms.
If a paid product or service fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation and/or compensation, depending on the circumstances and seriousness of the problem. We will not describe every purchase as non-refundable or require you to accept P-Bucks instead of a money refund when the law entitles you to a money refund.
There is no general promise of a change-of-mind refund for correctly supplied and described digital currency, used items or a subscription period you simply chose not to use. This does not affect statutory remedies, a specific refund promise, unauthorised-payment rights or other rights that apply to your purchase. Contact support with the transaction reference, date, account and problem so it can be assessed.
We may reasonably investigate a disputed or reversed payment and restrict only the affected, unverified grants while resolving it. Any correction should be proportionate and take account of valid spending and consumer rights. A good-faith complaint or lawful charge dispute is not, by itself, a reason to penalise an account. You can also contact your payment provider about rights and dispute options it offers.
15. Errors, balancing and changes to the service
We may correct a manifest pricing/display error, duplicated grant, corrupted score or unauthorised transaction, and make reasonable safety, security and gameplay adjustments. If an error affects a transaction you have already confirmed, we will explain the issue and provide an appropriate correction, choice or refund where required; we will not simply collect an unexpected higher price.
We may update games, item designs and free features. For a material adverse change to a paid feature or a service closure, we will provide reasonable notice where practicable and address unused paid entitlements and any remedies required by law. We will not rely on a general right to change the service to disregard a specific paid commitment. Urgent security or legal action may require a faster change.
16. Restrictions, suspension and appeals
We may proportionately remove content, limit a feature, suspend access or close an account when reasonably necessary to address a substantial breach, fraud, safety risk, legal requirement or unauthorised access. Where appropriate and lawful, we will explain the main reason, the scope of the action and how to ask for review. We may withhold details that would compromise another person’s privacy or safety, an investigation or security controls.
A minor misunderstanding or technical fault should not automatically justify permanent loss of paid value. You can contact us for review, provide relevant information and challenge an inaccurate decision. Necessary safety measures may remain in place during review. Restrictions do not remove statutory remedies or permit us to continue billing for a service we will not supply without an appropriate resolution.
17. Leaving and account closure
You can stop using the service at any time. To close an account or request deletion, contact us as described in the Privacy Policy; signing out is not account deletion. Cancel VIP renewal through the management portal, or ask us for assistance if access is unavailable, to avoid ongoing subscription billing.
We will explain the effect of closure on chats, item access and any information that must be retained. An ordinary closure does not automatically convert correctly supplied virtual items or unused currency into cash, but refund rights for a failure, incorrect billing or another protected reason remain available. Information already received or independently copied by another user may remain outside our control.
18. Responsibility and liability
We must provide the service and purchased features in accordance with applicable law and the commitments we make. Subject to rights that cannot be excluded, we do not promise uninterrupted operation, fault-free beta software, a particular game result, successful matchmaking or the trustworthiness of another user.
You are responsible for your own unlawful conduct and for losses you directly cause through an intentional or substantial breach, to the extent the law makes you responsible. You are not responsible merely because you make a good-faith report or because a technical fault beyond your control occurs.
To the extent permitted by law, we are not responsible for loss that was not reasonably foreseeable, was not caused by our breach or failure to exercise required care, or results from circumstances beyond our reasonable control. This wording does not excuse a breach of mandatory consumer guarantees, fraud or wilful misconduct, or exclude liability for death, personal injury, negligence, privacy obligations or other matters where exclusion is prohibited. It is not a blanket waiver of responsibility for other users’ actions where the law places an obligation on us.
19. Complaints, disputes and governing law
Contact Customer Support with the account, relevant dates, receipt or conversation reference and the resolution you seek. We will aim to address the concern promptly and provide a substantive response within 30 days, or explain the additional time needed. Urgent safety or security matters should be identified as such, but support is not an emergency service.
Australian law applies to these Terms, subject to any mandatory protections of the place in which you ordinarily reside. You may use a regulator, tribunal, court or other dispute process available to you under applicable law. These Terms do not impose compulsory private arbitration, waive class-action rights or require you to give up a non-excludable local consumer remedy.
Information about Australian purchase remedies is available from the ACCC. Your state or territory consumer agency may be able to assist with an individual dispute. Privacy and online-safety reporting options are set out in the Privacy Policy.
20. Changes to these Terms
We will identify changes by updating the effective date and version. Material changes will be brought to your attention before taking effect where reasonably practicable. If a change requires a new agreement or consent, we will seek it. A material price or renewal-benefit change must give affected subscribers a reasonable opportunity to cancel before the new conditions apply.
If you do not accept a prospective change, you can stop using the affected feature, cancel future renewal or contact us about account closure and any applicable remedy. An updated page will not be used to retrospectively remove a right or paid commitment that already arose.
21. General provisions
If part of these Terms is invalid or unenforceable, the remaining terms continue so far as they can operate fairly and lawfully. Not enforcing a provision immediately does not by itself waive it. Any transfer of the service or this agreement must preserve your accrued rights and should not materially reduce consumer protections; we will provide notice of a material operator change.
These Terms, the Privacy Policy and the specific offer terms presented before a transaction describe the agreement for the relevant service. They do not exclude a statement, representation or promise that applicable law requires to be honoured. You may keep a copy using your browser’s print/save function.
